Man Charged with Dog Fighting Fails to Show up For PreSentencing

Kristen In Glendale you talk a 76 year old man propagated guilty to three counts of dog fighting has missed his presentencing interviews. As a result when sentencing for the man was delayed this past Friday because you bailed to report to the adult probation and parole department for presentencing interviews. He pleaded guilty in July to three counts of third degree felony dog fighting. The judge handling the case is none too happy about this. Judge Dino Himonas ordered that the 76 year old man, John Clinton Smith, be taken into custody until the report is completed. It set in sync is scheduled for October 3 in the third district court. So he only has a few weeks to be found and brought into presentencing. This all started a few years ago in 2003 when animal control officers seized six pitfalls and a dog fighting equipment for training them such as treadmills from Smith’s home. In addition they also found videotapes and dog magazines according to the charging documents by animal control officers and the police. Originally they charged Smith with six dogs fighting felonies and six cruelty to animal misdemeanors. However, most of those charges were dismissed in exchange for his guilty pleas in this past July. Boy the justice system really moves slowly in Utah. Prior to Friday’s hearing to which Smith failed to show up. Smith told news reporters that he did not trained dogs to fight and, everybody uses treadmills to get dogs in the shape. Smith’s defense attorney, Edward brass, told judge Himonas that the man struggles with dementia and a mental condition although it’s not specify what that condition is. The defense attorney stated this is the reason Smith and they’ll to show up for his presentencing interview. However, prosecutor Fred Burmester stated that Smith failure to show up is further evidence that his ‘cavalier attitude’ towards the charges to which he’s plead guilty. Burmester stated before Smith was handcuffed and removed from the courtroom, ‘He doesn't take the charges or court seriously.’ Source: http://www.sltrib.com/news/ci_10391935
